Section 68 of Indian Succession Act states that no person, by reason of having interest in the estate of the Deceased or of his being an executor of a Will, shall be disqualified as a witness to prove the execution of the Will or to prove the validity or invalidity of the Will.
This section is the end result or corollary of section 67 of the Act. An executor appointed by the Will is a competent attesting witness and there is no objection to his proving the Will and acting as an executor. He, however, will lose any benefit given to him under the Will although such a benefit will be in the shape of salary or remuneration for his trouble for managing the estate.
