Legal Representative is defined under clause (11) of Section 2 of Code of Civil Procedure, which is "legal representative means a person who in law represents the estate of the deceased person and includes any person who intermeddles with the estate of the deceased and where a party sue or is sued in a representative character, the person on whom the estate devolves on the death of the party so suing or sued.
It transpires from the above, that the term 'legal representative' is wider in its scope than (a) a legal heir of a deceased (b) beneficiaries of the estate of the deceased c) an executor appointed under a Will (d) an administrator appointed by the court, though the term may inter-alia include all of them.
A person, though not appointed under a Will or by a court, may be a legal representative if he is found to represent in law, the estate of the deceased. The term is wide enough to include a person who intermeddles with the estate of the deceased and includes a legatee receiving a suit property through a deceased representative.
