The difference between contentious and non-contentious cases is that contentious Testamentary matters are when Caveat is filed by the beneficiary or legal heirs of the Deceased in the Testamentary Petition. The non-contentious matters simply mean that when there are no legal disputes between the parties or no objections taken by the parties.

Rule 370 of The Bombay High Court (Original Side) Rules, 1980 states that "non-contentious matters shall include application for Probate or Letters of Administration or Succession Certificate and the obtaining thereof when there is no contest as to the right thereto. They shall also include the issuing of Probate or Letters of Administration or Succession Certificate in contentious cases when the contest is terminated and all ex parte applications in matters of testacy and intestacy, not being proceedings in any suit."
