A Hindu coparcenary is distinguishable from a HUF (Hindu Undivided Family). A Hindu coparcenary is a narrower body within a HUF. It is a body of individuals which acquires interest by birth in the joint family property.
As we have seen in our previous article a HUF consists of a Karta, who is the eldest member of the family. Traditionally, the role of Karta of a HUF has been restricted to the senior-most male member of the family. However, in recent years, the law has been amended to include female members as well, and there have been cases where women have acted as Karta of their HUF.
Coparceners, on the other hand, are members of the HUF who have a right to share in the property of the HUF. Both the male and female members of the family can be Coparceners of the HUF. Coparceners have the right to demand a partition of the HUF's property, which means that they can claim their share of the property and split away from the HUF.
It is important to note that the roles of Karta and Coparceners are defined by Hindu law and may vary depending on the specific circumstances of each HUF.
