The primary duty of a court is to ascertain from the language of the Testator what were his intention while writing a will. They are entitled and bound to bear in mind other matters i.e. they must consider the surrounding circumstances, the position of the testator, his family relationships, the probability that he would use words in a particular sense and many other things.
It is well-settled rule of construction that the same words used in a Will are to be given the same meaning, unless there is a clear intention to the contrary.
