While drafting a Will it is not necessary that any technical word or legal language is required to be used, but it has to be in simple and clear wording to be such that the intention of the testator is known therefrom. It can be made in any form and in any language.

While construing the Will the primary duty of the court is to ascertain the real intention of the testator which the will itself by express words or by implication declares. The court must follow the “Armchair Rule” i.e. the court is entitled to put itself in the testator’s armchair.
