Section 10 of The Hindu Succession Act, 1956, deals with distribution of property among heirs of the intestate set forth in Class I.
In Mallipeddy Sheshaiah vs. N. Tulasamma and Laxmibai vs. Ansuya, it was held that “Wife” of a second marriage, entered into during the subsistence of first marriage, after the Act came into force, will not be entitled to inherit the property of the Deceased spouse.
Rule 2 of the Section gives effect to the general rule wherein each claimant has a share in his or her own right as in equal degree of kinship to the Deceased.
