If two inconsistent or contradiction clauses are found in Will, the latter clause is to prevail as being the last expression of the testator’s wish.
Before resorting to this rule the court will attempt to reconcile the apparently inconsistent dispositions and attempt to read the Will as a whole and where it is not possible to reconcile all the parts, only the last clause shall prevail.
This rule is to be applied strictly and the two inconsistent clauses must refer to the same subject-matter.
Example- The testator by the first clause of his Will leaves his estate of Ramnagar to ‘A’, and by the last clause of his Will leaves it to ‘B’ and not to ‘A’. The estate will go to B.
